Conditions of license: (1)  This license permits the use of this music as background music in this production only.  Alteration of the production may require an additional license.  (2)  Duplication of the production containing this music is limited to the number of copies specified.  (3)  Unless otherwise stated,  the territory covered by this agreement is the United States and its possessions.  (4)  This license is not valid for the use of this music in adult-entertainment productions,  or in any productions where the music constitutes the primary focus of audience attention,  or where the music is offered as a separate element.  (5)  Unless specifically granted,  this license does not grant any rights of public performance.  (6)  The musical compositions herein licensed may not be duplicated or offered for sale except as an integral part of this production.  (7)  Kowal's liability for this license shall not exceed the consideration paid.  (8)  All rights not herein granted are reserved by Kowal.

"Broadcast"  includes commercial broadcasting stations,  commercial networks,  satellite and microwave networks (except for company-owned networks used exclusively for non-commercial business).

"Commercial"  means an advertising message produced to encourage retail sales.

"Promo"  means an advertising message about a broadcaster produced for on-location use.

An "infomercial"  is an advertising message longer than two minutes in length.

"Pay-Per-View"  is any program for which the viewer must pay an additional premium fee to the program supplied.

"Theatrical"  means a production which will be exhibited in commercial theaters.  This license includes limited performing rights.

"Music-On-Hold"  is any music or music voice message heard on a private or public telephone system.

"Public Performance"  means any performance of music otherwise subject to licensing by ASCAP or BMI.
