Last Will and Testament of James Dunham In the name of the
Benevolent Father of all: I James Dunham of Warren County
in the State of Ohio do make and publish this my last will
and testament: First. I give and devise to my beloved wife
all my estate both real and personal, except an eighty acre
tract of land in Porter County in the State of Indiana
during her natural life, the same to under her control and
management and to receive for her support and maintainance
the rents and proceeds thereof after my funeral expences and
all my just debts are paid. The said eighty acres of land
in Porter County in the State of Indiana to be sold by my
Executor and the money arising therefrom to be paid over to
my wife for her use and the use of the family and to pay
debts, as she in her discretion may think best to apply it.
Nothing in this item of this my will shall be so construed
so as to authorise my said wife or any other person to sell
any of my real estate during the life time of my wife except
the above mentioned eighty acres in the State of Indiana.
Second. It is my will that after the death of my said wife
all my estate then remaining both real and personal shall be
equally divided among my following named children towit
William H. Dunham, Rachel [V.?] Williams late Rachel [V.?]
Dunham, John Dunham, Mary Ann Dunham, James H. Dunham and
Martha Dunham and to their heirs and assigns to be
distributed as follows towit, My son William H. Dunham to
take the Fordyce Farm on which he now lives containing about
fifty five acres at eighteen hundred dollars, and after
deducting his equal share of the estate therefrom he is to
pay the residue thereof equally to my three daughters. All
the claims I hold against my said son William H. Dunham is
to be released and not to be accounted for by him in the
division of my estate. My sons John Dunham and James H.
Dunham to take the farm on which I now live which is to be
divided equally between them for which they are to account
for the sum of four thousand [six?] hundred dollars and
after deducting therefrom their equal shares of my estate
they are required to pay the residue to my three above named
daughters in equal portions, but if my said two sons shall
think that I have put too high a price on said farm then the
same shall be apprised by three disinterested freeholders
and by their appraisement they are to be bound and to pay
the residue after deduction their shares to my three said
daughters as above directed. Third. I do hereby nominate
and appoint my son William H. Dunham Executor of this my
last will and testament, hereby authorizing and empowering
him, to compromise adjust and release and discharge in such
manner and upon such terms as he may think proper, the debts
& claims due me. I do hereby revoke all former wills by me
made. In testimony whereof I have hereunto set my hand and
seal this 8th day of January in the year of our Lord one
thousand eight hundred & fifty. Signed and acknowledged by
