Last Will and Testament of Elizabeth Vanhorn <
In the name of God Amen. I Elizabeth Vanhorn of Winchester
Virginia being of sound mind and memory and being impressed
with the uncertainty of life do hereby make and declare this
my Last Will and Testament in words and degrees following. <
In the first place I commit my soul unto my Savior's hands
and my body to the earth to be buried in a decent and
Christian manner.
In the second place I direct that my just debts and funeral
expenses be paid. <
Thirdly I give and bequeath unto my daughter Mary Ann Coontz
the wife of John Coontz (to be held however by my brother
Mathias Rutter in trust for her own separate use and
benefit) one feather bed and bed clothing one pair bedsteads
half dozen silver tea spoons one bureau, one copper kettle
and my large rocking chair and also my large bible and also
the property sold by George Kremer (---) Constable
belonging at the time of sale to John Coontz and purchased
by me at said sale a list of which the said Kremer has in
his possession. <
Fourthly I will and bequeath unto my daughter Elizabeth a
feather bed a bureau and a bedstead. <
Fifthly I will and bequeath unto my son Barnett Vanhorn my
Franklin stove, my desk, one double coverlet, and two calico
quilts. <
6th I will and bequeath unto my granddaughter Elizabeth Wall
daughter of Wm. T Wall the feather bed bedding and bedstead
which I have occupied myself. >
7th I will and direct that my Executor proceed to sell the
balance of my property and collect the debts due me and
after paying my just debt I desire that the remainder of my
estate be divided into six shares and (passed) over as
follows, one share I will and bequeath to my daughter Mary,
one other to my son Barnett, one other to Lydia Bucher, one
other to Elizabeth Wall, one other to Rebecca (H---y) and
the other to my Grandchildren William Bull and James Bull
the children of my deceased daughter Matilda, I will and
desire however that the property willed to my daughter Mary
and also the shares of my said daughters Mary and Lydia on
the final distribution of my estate shall be held by my
brother Mathias Rutter in trust for their sole and separate
use as I do not wish it to be under the control of their
husbands or be in any manner liable for their debt or
contract and in case any creditor should attempt to make the
same liable for the debt of my sons in law John Coontz and
Moses Bucher then I give and devise the property so
bequeathed to my said daughter Mary and the said shares of
my said two daughters Mary and Lydia heretofore referred to,
to my said brother Mathias Rutter his heirs and assigns
forever believing that he will make a proper use of the
same. It is also my will and desire that my brother Mathias
Rutter settle the account between my sons in law John Koontz
and William F Wall and whatever balance Mary be due from
said Coontz to said Wall shall be kept out of the share of
my said daughter Mary and paid over by my said brother to
William F Wall in case the said Coontz shall fail to pay the
sum which he has promised to do before the final
distribution of my estate. <
Lastly I hereby constitute and appoint my brother Mathias
Rutter Executor of this my Last Will and Testament hereby
declaring this as my Last Will and Testament and revoking
all others. In witness whereof I have hereunto set my hand
and seal this 13th February 1846. The words "and also my
large bible" on the first page interlined before signing.
Signed Sealed published and declared by said Elizabeth
Vanhorn as her Last Will and Testament in our presence who
at her request and in her presence have hereunto subscribed
